Sexual Harassment

Sexual Harassment is a form of discrimination.
California Fair Employment and Housing Law


The California Department of Fair Employment and Housing (DEFH) prohibits sexual harassment in the workforce and defines it as:
“unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature from any person directed towards or in the presence of an employee or applicant when…
  • Condition of employment
  • Used as basis for employment decisions
  • Interferes with an individuals work performance or creating an intimidating hostile, or offensive working environment”

There are 2 types of sexual harassment:
Quid Pro Quo
  • When the harasser is in a position of authority over their victim.
Hostile Environment
  • When the harasser exhibits hostile misconduct that unreasonably interferes with an individuals work performance or creates an intimidating or offensive work environment.

What to do:
  • Instruct the harasser to stop
  • Document all accounts of harassment including:
    • What they said/did​
    • Date, time, and place
    • Who else was there and witnessed the incident
  • Report to supervisor or Human Resources
  • Report to DFEH
  • ​Report to the Federal Equality Employment Opportunity Commission within 300 days of incident
