Sexual Harassment

Sexual Harassment is a form of discrimination.
Florida Statues Section 110.1221

Chapter 60L-36.004 of the Florida Administrative Code prohibits sexual harassment in the workforce and defines it as:
“unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature from any person directed towards or in the presence of an employee or applicant when…
  • Condition of employment
  • Used as basis for employment decisions
  • Interferes with an individuals work performance or creating an intimidating hostile, or offensive working environment”

There are 2 types of sexual harassment:
Quid Pro Quo
  • When the harasser is in a position of authority over their victim.
Hostile Environment
  • When the harasser exhibits hostile misconduct that unreasonably interferes with an individuals work performance or creates an intimidating or offensive work environment.
